NOTICE OF PROPOSED CHANGES TO AMEND REGULATIONS DEALING WITH THE TERMS AND CONDITIONS OF THE ALASKA SUPPLEMENTAL EDUCATION LOAN PROGRAM, THE ALASKA FAMILY EDUCATION LOAN PROGRAM, THE ALASKA EDUCATION GRANT AND SCHOLARSHIP PROGRAMS, AND THE WICHE PROFESSIONAL STUDENT EXCHANGE PROGRAM OF THE ALASKA COMMISSION ON POSTSECONDARY EDUCATION

BRIEF DESCRIPTION

The Alaska Commission on Postsecondary Education proposes to amend, adopt, and repeal regulations relating to the terms and conditions of the Alaska Supplemental Education Loan Program, the Alaska Family Education Loan Program, the Alaska Education Grant Program, the Alaska Performance Scholarship Program, and the WICHE Professional Student Exchange Program.

The Alaska Commission on Postsecondary Education (ACPE) proposes to amend, adopt, and repeal regulations in Title 20, Chapters 15, 16, and 18 of the Alaska Administrative Code, dealing with terms and conditions including the following:

(1) 20 AAC 15.537(a) is proposed to be changed as follows: correcting the citation listed for annual and aggregate loan limits for the Family Education Loan Program. The existing citation points to the wrong subsection.

(2) 20 AAC 15.537(b) is proposed to be changed as follows: remove the condition of borrowing on behalf of more than one student in order to receive additional loans under the Alaska Family Education Loan program, when a family member has borrowed up to the aggregate limit.

(3) 20 AAC 15.735(p) is proposed to be changed as follows: correcting the citation listed for annual and aggregate loan limits for the Alaska Supplemental Education Loan Program. The existing citation points to the wrong subsection.

(4) 20 AAC 15.735 is proposed to be changed as follows: add a new subsection that will allow a borrower to receive additional loans under the Alaska Supplemental Education Loan Program, when a student has borrowed up to the aggregate limit.

(5) 20 AAC 15.745(b) is proposed to be changed as follows: give ACPE the authority to offer a student the option of entering repayment immediately upon disbursement of the Alaska Supplemental Education Loan Program loan.

(6) 20 AAC 15.910(c) is proposed to be changed as follows: include additional provisions related to delinquency and default that would apply to the Washington, Wyoming, Alaska, Montana, Idaho (WWAMI) medical education program. These provisions would align the WWAMI program with the Alaska Supplemental Education Loan Program and Alaska Family Education Loan Program, specific to preventing default, loan rehabilitation, credit reporting the status of a loan and the option of alternative repayment schedules subsequent to default.

(7) 20 AAC 15.930(b) is proposed to be changed as follows: provide ACPE the option of requiring a cosigner’s signature on a promissory note be notarized when not signed through an electronic method.

(8) 20 AAC 15.935(e) is proposed to be changed as follows: allow the Alaska Student Loan Corporation to determine a borrower’s annual loan amount based on the student’s enrollment level, which may not exceed the limits established by the Corporation.

(9) 20 AAC 15.935(e)(1) is proposed to be changed as follows: remove the specified annual loan limits based on an undergraduate student’s enrollment level.

(10) 20 AAC 15.935(e)(2) is proposed to be changed as follows: remove the specified annual loan limits based on a graduate student’s enrollment level.

(11) 20 AAC 15.935(e)(3) is proposed to be changed as follows: remove the specified annual loan limit for an eligible student attending a career education program that culminates in a terminal certificate.

(12) 20 AAC 15.950(a) is proposed to be changed as follows: remove the requirement that a loan must be disbursed in at least two installments based on the terms, quarters, or semesters used by the school of attendance.

(13) 20 AAC 15.950(b) is proposed to be changed as follows: remove the requirement for the school to distribute the ACPE Disbursement and Receipt Certification Form with each disbursement.

(14) 20 AAC 15.950(e) is proposed to be changed as follows: remove the schools responsibility for completion and retention of the ACPE Disbursement and Receipt Certification Form in the students file.

(15) 20 AAC 15.970(e)(3) is proposed to be repealed. The intended effect of this repeal is to eliminate the delinquency threshold for the garnishment of a defaulted borrower or cosigner’s Alaska Permanent Fund Dividend.

(16) 20 AAC 15.970(e) is proposed to be changed as follows: add a new paragraph stating a borrower or cosigner is no longer considered in default when entering into a loan rehabilitation agreement with ACPE.

(17) 20 AAC 15.970(k) is proposed to be changed as follows: remove the statement that a loan that has become 270 or more days past due is not eligible for an alternative payment schedule.

(18) 20 AAC 16.015(a)(3) is proposed to be changed as follows: correcting the citation listed for grant awards under the Alaska Education Grant Program when applicants are enrolled as on-time students. The existing citation points to the wrong subsection.

(19) 20 AAC 16.034(b)(1) is proposed to be changed as follows: correcting the citation listed for increased grant awards under the Alaska Education Grant Program when applicants are enrolled as on-time students. The existing citation points to the wrong subsection.

(20) 20 AAC 16.210(a)(2)(B)(i) is proposed to be changed as follows: clarify the minimum credit requirements for second or subsequent-year Alaska Performance Scholarship recipient enrolled full time in an academic program of study.

(21) 20 AAC 16.210(a)(2)(B)(ii) is proposed to be changed as follows: clarify the minimum credit requirements for second or subsequent-year Alaska Performance Scholarship recipient enrolled half-time in an academic program of study.

(22) 20 AAC 16.220(e) is proposed to be changed as follows: replace “calendar” year of attendance with “academic” year of attendance.

(23) 20 AAC 16.220(e) is proposed to be changed as follows: add a new paragraph to clarify disbursements cannot exceed the lifetime maximum of 4 years at the annual amount.

(24) 20 AAC 18.030(d) is proposed to be changed as follows: provide ACPE the option of requiring a cosigner’s signature on a WICHE Professional Student Exchange Program promissory note be notarized when not signed through an electronic method.

(25) 20 AAC 18.150 is proposed to be changed as follows: add a new subsection stating a borrower or cosigner is no longer considered in default when entering into a loan rehabilitation agreement with the ACPE.

The comments must be received not later than 4:30 p.m. on December 18, 2022.

BRIEF DESCRIPTION

The Alaska Commission on Postsecondary Education (the commission) proposes to change regulations in Title 20, Chapter 17 of the Alaska Administrative Code dealing with authorization of postsecondary education intuitions to operate in Alaska. The proposed changes to these regulations streamline the authorization processes, align fees with services, and provide greater oversight of institutional financial health, student consumer protection, and monitoring of changes. This project includes regulations that are being amended, repealed and readopted and repealed.

alaska commission on postsecondary education joined by u.s. department of federal student aid and postsecondary institutions across the state to launch the alaska fafsa completion initiative

anchorage – the alaska commission on postsecondary education (acpe) is pleased to announce the alaska fafsa® completion initiative in collaboration with the u.s. department of education federal student aid (fsa) and a variety of postsecondary institutions across alaska. the intent of this initiative is to increase statewide fafsa® completion levels. historically, alaska fafsa® completion rates rank among the lowest in the nation and through the work of this initiative, students, families, and schools will have enhanced access to fafsa® completion resources available throughout alaska. in light of the continuing covid-19 pandemic, at the start of 2021, alaska had the lowest fafsa® completion rate nationwide.

each year, the federal government awards $120 billion in financial aid, grants, work-studies, and student loans. by completing the fafsa, alaskan students also open up a sea of funding opportunities in-state for aid, such as the alaska performance scholarship (of up to $19,800), the alaska education grant, and institutional aid programs.

as communities, school districts, and postsecondary institutions continue to adapt and adjust to the ongoing challenges related to the covid-19 pandemic, the statewide alaska fafsa® completion initiative sheds light on much-needed resources for alaska’s students. the initiative offers a newly developed centralized website for students, families, teachers, counselors, and any other education stakeholders to identify and access statewide fafsa® completion resources in one place. the alaska fafsa completion website offers continually updated information about:

notice of proposed changes on appeal process related to participation in the national council for state authorization reciprocity agreements (nc-sara) program in the regulations of the alaska commission on postsecondary education

the alaska commission on postsecondary education proposes to change regulations on the appeal process related to participation in the national council for state authorization reciprocity agreements (nc-sara) program.

the alaska commission on postsecondary education (acpe) proposes to adopt regulations changes in title 20, chapter 17 of the alaska administrative code, dealing with hearing and resolving appeals from institutions that may be denied participation in the national council for state authorization reciprocity agreements (nc-sara) program, including the following:

 

  1. 20 aac 17.018(a), denial of exemption. the proposed change would set out an appeal process if the commission denies an application for participation in nc-sara.
  2. 20 aac 17.018(b), denial of exemption. the proposed change would clarify the process for requesting a hearing in response to an appeal decision.
  3. 20 aac 17.018, denial of exemption. adding subsection (c) is proposed to make explicit the appellant’s status as a participant or non-participant pending any appeal process decision.

11/28/2017 – NOTICE OF PROPOSED REGULATION CHANGES OF THE ALASKA COMMISSION ON POSTSECONDARY EDUCATION

The Alaska Commission on Postsecondary Education proposes to amend, adopt, and repeal regulations relating to the terms and conditions of the Alaska Supplemental Education Loan Program, the Alaska Education Grant Program, the Alaska Performance Scholarship Program, and the WICHE Professional Student Exchange Program.

The Alaska Commission on Postsecondary Education (ACPE) proposes to amend, adopt, and repeal regulations in Title 20, Chapters 15, 16, and 18 of the Alaska Administrative Code, dealing with terms and conditions including the following:

(1)       20 AAC 15.700(a) will be amended to reflect a change in the name of the federal loan program and an amendment to clarify the Alaska Supplemental Education Loan is available to help pay allowable costs of attendance.

(2)       20 AAC 15.705(c) will be amended to allow the Alaska Student Loan Corporation to set the FICO score and other eligibility criteria for applicants or endorsers under the Alaska Supplemental Education Loan Program.

(3)       20 AAC 15.715(a) will be amended to reflect the use of the acronym for the Free Application for Federal Student Aid (FAFSA).

(4)       20 AAC 15.785 will be amended to reflect a change in the description of eligible schools that are authorized to participate in federal student aid programs under 20 U.S.C 1070-1099d.

(5)       20 AAC 15.910(a) will be amended to remove the term AlaskAdvantage from the consolidation loan program.

(6)       20 AAC 15.910(2) is amended to correct the applicable subsection.

(7)       20 AAC 15.910(e) will be amended to remove AlaskAdvantage from the title of the Alaska Education Grant Program.

(8)       20 AAC 15.922(e) will be amended to address an institution's requirement to verify a student's eligibility prior to each disbursement.

(9)       20 AAC 15.922(k) will be amended to eliminate the names of specific commission-approved electronic funds transfer (EFT) programs and replace those names with a statement that EFT methods must be approved by the ACPE.

(10)     20 AAC 15.940(j) will be amended to allow the Alaska Student Loan Corporation to set the FICO score and other criteria for cosigners

(11)     20 AAC 15.950(a) will be amended to reflect that disbursements will be made in equal amounts unless an institution designates alternate amounts, which do not exceed the total loan amount.

(12)     20 AAC 15.965(e) will be repealed and readopted to include a new subsection. The new subsection will permit the Executive Director to request and receive additional documentation of undue financial hardship resulting from the same medical condition exceeding five years in length.

(13)     20 AAC 15.990(14), setting out the definition of ASLNet, the name of the commission's previous internet financial aid packaging and delivery system will be repealed.

(14)     20 AAC 16.015(1) will be amended to accurately display the Free Application for Federal Student Aid.

(15)     20 AAC 16.030(a) will be amended to reflect the use of the acronym for the Free Application for Federal Student Aid (FAFSA) and the Institutional Student Information Record (ISIR).

(16)     20 AAC 16.040 will be amended to add a new subsection requiring institutions to maintain documentation of verification of the identity of the student receiving any grant money.

(17)     20 AAC 16.215(d) will be amended to permit the executive director to consider applications from students submitting a completed FAFSA or a completed alternate application provided by the commission after June 30, but before the end of the school year.

(18)     20 AAC 16.220(c) will be amended to describe "half-time enrollment" instead of "part-time enrollment."

(19)     20 AAC 16.250 will be amended to set out allowable costs of attendance for students enrolled full-time or on-time.

(20)     20 AAC 16.250 will be amended to add a new subsection to set out allowable costs of attendance for students enrolled less than full-time.

(21)     20 AAC 15.990 will be amended by adding a new subsection to provide a definition of "vocational program" or "vocational certificate program."

(22)     20 AAC 18.025(c), regarding the non-award of education loans under AS 14.43.091-14.43.160 or AS 14.43.170-14.43.075 to that person who receives a Professional Student Exchange loan for the same period of attendance, is repealed.

The Alaska Student Loan Corporation proposes to amend and repeal regulations on applicant eligibility relating to the Alaska Education Loan Refinancing Program.

The Alaska Student Loan Corporation (ASLC) proposes to amend and repeal regulation in Title 20, Chapter 14 of the Alaska Administrative Code, dealing with applicant eligibility including the following:

(1)       20 AAC 14.225(a)(2) regarding state residency requirements at the time of application will be repealed. This change would allow applicants to utilize cosigners who are not state residents.

(2)       20 AAC 14.225(a)(4) dealing with an applicant's employment or ability to document a long-term source of income will be repealed. The commission has the authority to request additional documentation to determine the applicants eligibility under 20 AAC 14.225(c).

 (3)      20 AAC 14.225(c) will be amended to include a provision for the commission to request additional documentation to determine the borrower's ability to repay the loan obligation.

NOTICE OF PROPOSED CHANGES TO ADOPT REGULATIONS DEALING WITH THE TERMS AND CONDITIONS OF A NEW LOAN REFINANCING PROGRAM OF THE ALASKA STUDENT LOAN CORPORATION

 The Alaska Student Loan Corporation proposes to add regulations relating to a new loan program, the Alaska Education Loan Refinance Program, and the addition of a new chapter to permit related regulations to be located together within a single chapter.

 

The Alaska Student Loan Corporation (ASLC) proposes to add a new chapter to Title 20, Chapter 14. Alaska Student Loan corporation, adopt regulations in Title 20, Chapter 14 of the Alaska Administrative Code, dealing with the Alaska Education Loan Refinance Program, and to move certain regulations in Title 20 Chapter 15 to Title 20 Chapter 14, including the following:

 

(1)        20 AAC 14.200 – 20 AAC 14.215, Refinancing loan application requirements and processes, is proposed to create application requirements for the Alaska Education Loan Refinance Program.

 

(2)        20 AAC 14.220, Education loans eligible for refinancing, is proposed to define the types of loans eligible for inclusion in the refinancing program.

 

(3)        20 AAC 14.225, Applicant eligibility, is proposed to set out minimum requirements for an applicant to be determined eligible to borrow under the refinancing program.

 

(4)        20 AAC 14.230, Conditions and limitations of refinancing loans, is proposed to define the amount of the refinancing loan and recognize ASLC's ability to establish minimum and maximum loan amounts.

 

(5)        20 AAC 14.235, Interest rates and fees, is proposed to establish ASLC's ability to set interest rates and fees for the refinancing program.

 

(6)        20 AAC 14.240, Terms of repayment, is proposed to establish repayment term lengths and minimum monthly payment amounts for the refinancing program.

 

(7)        20 AAC 14.900, General Provisions, is proposed to establish general provisions applicable to 20 AAC 14.

 

(8)        20 AAC 15.810 to 20 AAC 15.890 is proposed to be repealed. The intended effect of this repeal is to permit and conform to the readoption these regulations in new chapter 20 AAC 14.

REQUEST FOR INFORMATION (RFI): State Student Loan Online Application and Online Account Management (self service)

The Alaska Commission on Postsecondary Education (ACPE) is seeking information for the purpose of learning about options available to the state to design and implement new online student loan application process along with the associated online customer self-service portal for individual account management. Specifically, ACPE seeks to learn about the options for specifications, capabilities, and functionality/flexibility/scalability of loan application and customer self-service portal software, along with the associated price ranges and implementation timelines.

ACPE is particularly interested in learning about the functionality and options included in similar systems in use in other states or student lending institutions and requests 1) contact information for other states or institutions utilizing vendor-created online student loan application system, and 2) links to any product information or demonstrations available online.

NOTICE OF REQUEST FOR PROPOSAL OF THE ALASKA COMMISSION ON POSTSECONDARY EDUCATION

RFP 2015-0500-2833 Alternative (Non-federal) Education Loan Collection Services

The Department of Education and Early Development, Alaska Commission on Postsecondary Education, is soliciting proposals for defaulted education loan collection services. The loan portfolio consists of alternative loans that have never been federally guaranteed.

The loans ACPE intends to place with a Contractor are not federal education loans subject to Title IV regulations, but are alternative loans subject to State of Alaska regulations. Loan terms, interest rates, and maximum loan amounts vary depending on the year of inception and the loan type. Loans include both fixed interest rates and variable interest rates.

A copy of the statutes and regulations governing the loan programs is available at www.ACPE.alaska.gov, in the "About Us" section.

Proposals must be received no later than 1:30 P.M., Alaska Time on January 12, 2015. Electronically submitted proposals are preferred. Oral proposals are not acceptable. An Offeror's failure to submit their proposal prior to the deadline will cause the proposal to be disqualified. Late proposals or amendments will not be opened or accepted for evaluation.

The Alaska Commission on Postsecondary Education proposes to change regulations relating to the Alaska state financial aid programs and to the authorization of postsecondary institutions operating in Alaska.

The Alaska Commission on Postsecondary Education (ACPE) proposes to adopt regulation changes in Title 20 Chapters 15, 16 and 17 of the Alaska Administrative Code dealing with regulation of the Alaska state financial aid programs and postsecondary institutions (AS 14.43 and 14.48), including the following:

  • Revise loan deferment eligibility (15.195);
  • Set loan award maximums based on enrollment status: on-time, full-time, half-time (15.935);
  • Set out allowable uses of half-time loan awards (15.935);
  • Clarify that post-enrollment grace period is up to six months (15.745);
  • Clarify that borrower or cosigner who previously defaulted may be eligible for a new loan based on voluntary repayment of defaulted loan (15.970);
  • Consolidate and clarify regulations related to general ASEL and FEL provisions (throughout Chapter 15);
  • Rename the Alaska Education Grant pursuant to SB 195 (throughout Chapter 16);
  • Modify grant eligibility (16.010, 16.030);
  • Revise grant applicant prioritization criteria (16.020);
  • Repeal reference to federal LEAP funding (16.021);
  • Clarify grant application procedure (16.030);
  • Revise award amounts and computation of financial need (16.034 and 16.037);

RFP 2015-0500-2693 Grant and Scholarship Servicing System

The Alaska Commission on Postsecondary Education (ACPE) is soliciting proposals for a contractor with the appropriate experience and skills to develop and implement a grant and scholarship servicing system. The system will house confidential student data from multiple sources for the purpose of awarding State grant and scholarships to eligible recipients.

Recent legislation provides for significant changes to the Alaska Education Grant (AEG), the requirements for which have not yet been fully identified, but which are expected to result in a full program redesign. To implement the changes, ACPE is seeking to purchase a new grant and scholarship servicing system to service the grant and the state's existing Alaska Performance Scholarship (APS). The successful offeror will be tasked with developing the software for ACPE to service the both the AEG and APS, including selection of the recipient, awarding of funds, and tracking of continuing eligibility; and for postsecondary schools and individual students to manage their grant and scholarship awards. 2. General subject of regulations: Changes in Title 20 Chapter 15 of the Alaska Administrative Code dealing with regulations relating to the Alaska state financial aid programs, including provisions that would:

• allow the ASLC increased flexibility to set interest rates (20 AAC 15.189);
• amend dates after which interest rates may be set to allow for earlier notification (20 AAC 15.855);
• allow for the ASLC to annually set an origination fee (20 AAC 15.855);
• generally describe relevant factors ASLC may consider when establishing fees and rates for loans (20 AAC 15.855); and
• make general housekeeping and conforming changes.
