NOTICE OF PROPOSED CHANGES TO AMEND REGULATIONS DEALING WITH THE TERMS AND CONDITIONS OF THE ALASKA SUPPLEMENTAL EDUCATION LOAN PROGRAM, THE ALASKA FAMILY EDUCATION LOAN PROGRAM, THE ALASKA EDUCATION GRANT AND SCHOLARSHIP PROGRAMS, AND THE WICHE PROFESSIONAL STUDENT EXCHANGE PROGRAM OF THE ALASKA COMMISSION ON POSTSECONDARY EDUCATION
BRIEF DESCRIPTION
The Alaska Commission on Postsecondary Education proposes to amend, adopt, and repeal regulations relating to the terms and conditions of the Alaska Supplemental Education Loan Program, the Alaska Family Education Loan Program, the Alaska Education Grant Program, the Alaska Performance Scholarship Program, and the WICHE Professional Student Exchange Program.
The Alaska Commission on Postsecondary Education (ACPE) proposes to amend, adopt, and repeal regulations in Title 20, Chapters 15, 16, and 18 of the Alaska Administrative Code, dealing with terms and conditions including the following:
(1) 20 AAC 15.537(a) is proposed to be changed as follows: correcting the citation listed for annual and aggregate loan limits for the Family Education Loan Program. The existing citation points to the wrong subsection.
(2) 20 AAC 15.537(b) is proposed to be changed as follows: remove the condition of borrowing on behalf of more than one student in order to receive additional loans under the Alaska Family Education Loan program, when a family member has borrowed up to the aggregate limit.
(3) 20 AAC 15.735(p) is proposed to be changed as follows: correcting the citation listed for annual and aggregate loan limits for the Alaska Supplemental Education Loan Program. The existing citation points to the wrong subsection.
(4) 20 AAC 15.735 is proposed to be changed as follows: add a new subsection that will allow a borrower to receive additional loans under the Alaska Supplemental Education Loan Program, when a student has borrowed up to the aggregate limit.
(5) 20 AAC 15.745(b) is proposed to be changed as follows: give ACPE the authority to offer a student the option of entering repayment immediately upon disbursement of the Alaska Supplemental Education Loan Program loan.
(6) 20 AAC 15.910(c) is proposed to be changed as follows: include additional provisions related to delinquency and default that would apply to the Washington, Wyoming, Alaska, Montana, Idaho (WWAMI) medical education program. These provisions would align the WWAMI program with the Alaska Supplemental Education Loan Program and Alaska Family Education Loan Program, specific to preventing default, loan rehabilitation, credit reporting the status of a loan and the option of alternative repayment schedules subsequent to default.
(7) 20 AAC 15.930(b) is proposed to be changed as follows: provide ACPE the option of requiring a cosigner’s signature on a promissory note be notarized when not signed through an electronic method.
(8) 20 AAC 15.935(e) is proposed to be changed as follows: allow the Alaska Student Loan Corporation to determine a borrower’s annual loan amount based on the student’s enrollment level, which may not exceed the limits established by the Corporation.
(9) 20 AAC 15.935(e)(1) is proposed to be changed as follows: remove the specified annual loan limits based on an undergraduate student’s enrollment level.
(10) 20 AAC 15.935(e)(2) is proposed to be changed as follows: remove the specified annual loan limits based on a graduate student’s enrollment level.
(11) 20 AAC 15.935(e)(3) is proposed to be changed as follows: remove the specified annual loan limit for an eligible student attending a career education program that culminates in a terminal certificate.
(12) 20 AAC 15.950(a) is proposed to be changed as follows: remove the requirement that a loan must be disbursed in at least two installments based on the terms, quarters, or semesters used by the school of attendance.
(13) 20 AAC 15.950(b) is proposed to be changed as follows: remove the requirement for the school to distribute the ACPE Disbursement and Receipt Certification Form with each disbursement.
(14) 20 AAC 15.950(e) is proposed to be changed as follows: remove the schools responsibility for completion and retention of the ACPE Disbursement and Receipt Certification Form in the students file.
(15) 20 AAC 15.970(e)(3) is proposed to be repealed. The intended effect of this repeal is to eliminate the delinquency threshold for the garnishment of a defaulted borrower or cosigner’s Alaska Permanent Fund Dividend.
(16) 20 AAC 15.970(e) is proposed to be changed as follows: add a new paragraph stating a borrower or cosigner is no longer considered in default when entering into a loan rehabilitation agreement with ACPE.
(17) 20 AAC 15.970(k) is proposed to be changed as follows: remove the statement that a loan that has become 270 or more days past due is not eligible for an alternative payment schedule.
(18) 20 AAC 16.015(a)(3) is proposed to be changed as follows: correcting the citation listed for grant awards under the Alaska Education Grant Program when applicants are enrolled as on-time students. The existing citation points to the wrong subsection.
(19) 20 AAC 16.034(b)(1) is proposed to be changed as follows: correcting the citation listed for increased grant awards under the Alaska Education Grant Program when applicants are enrolled as on-time students. The existing citation points to the wrong subsection.
(20) 20 AAC 16.210(a)(2)(B)(i) is proposed to be changed as follows: clarify the minimum credit requirements for second or subsequent-year Alaska Performance Scholarship recipient enrolled full time in an academic program of study.
(21) 20 AAC 16.210(a)(2)(B)(ii) is proposed to be changed as follows: clarify the minimum credit requirements for second or subsequent-year Alaska Performance Scholarship recipient enrolled half-time in an academic program of study.
(22) 20 AAC 16.220(e) is proposed to be changed as follows: replace “calendar” year of attendance with “academic” year of attendance.
(23) 20 AAC 16.220(e) is proposed to be changed as follows: add a new paragraph to clarify disbursements cannot exceed the lifetime maximum of 4 years at the annual amount.
(24) 20 AAC 18.030(d) is proposed to be changed as follows: provide ACPE the option of requiring a cosigner’s signature on a WICHE Professional Student Exchange Program promissory note be notarized when not signed through an electronic method.
(25) 20 AAC 18.150 is proposed to be changed as follows: add a new subsection stating a borrower or cosigner is no longer considered in default when entering into a loan rehabilitation agreement with the ACPE.

anchorage – the alaska commission on postsecondary education (acpe) is pleased to announce the alaska fafsa® completion initiative in collaboration with the u.s. department of education federal student aid (fsa) and a variety of postsecondary institutions across alaska. the intent of this initiative is to increase statewide fafsa® completion levels. historically, alaska fafsa® completion rates rank among the lowest in the nation and through the work of this initiative, students, families, and schools will have enhanced access to fafsa® completion resources available throughout alaska. in light of the continuing covid-19 pandemic, at the start of 2021, alaska had the lowest fafsa® completion rate nationwide.
each year, the federal government awards $120 billion in financial aid, grants, work-studies, and student loans. by completing the fafsa, alaskan students also open up a sea of funding opportunities in-state for aid, such as the alaska performance scholarship (of up to $19,800), the alaska education grant, and institutional aid programs.

the alaska commission on postsecondary education proposes to change regulations on the appeal process related to participation in the national council for state authorization reciprocity agreements (nc-sara) program.
the alaska commission on postsecondary education (acpe) proposes to adopt regulations changes in title 20, chapter 17 of the alaska administrative code, dealing with hearing and resolving appeals from institutions that may be denied participation in the national council for state authorization reciprocity agreements (nc-sara) program, including the following:
- 20 aac 17.018(a), denial of exemption. the proposed change would set out an appeal process if the commission denies an application for participation in nc-sara.
- 20 aac 17.018(b), denial of exemption. the proposed change would clarify the process for requesting a hearing in response to an appeal decision.
- 20 aac 17.018, denial of exemption. adding subsection (c) is proposed to make explicit the appellant’s status as a participant or non-participant pending any appeal process decision.
